KoolIRC Acceptable Use Policy ::.

I. Introduction
This document is not intended to
be an unassailable legal
agreement. It is instead
intended to provide
as to how
KoolIRC works, what we
consider to be acceptable and
what we do not. As such, we
expect a certain level of common
sense and intuition. If you are
not sure about anything, please
speak
to an IRCop (join the #KoolIRC)
or email
IRCrazy@koolirc.net with
your question.
II. Terms of Use

NO Harassment of ANY Kind. (Including
Flooding, spamming, sexually
harassing on a public
channel.)

NO Advertising Or Spam
Allowed.

Only People Over 13 yrs Are
Allowed To Use This Network

Unauthorized access of a
nickserv/chanserv account
-
Connecting unauthorized
servers to the network.
-
Knowingly or carelessly
running any program that may
damage or place excessive
load on a server or the
network, including flood
bots and clone bots.
-
NO Illegal Activities e.g.
Nuking, Child Porn or
Bestiality, Hacking.
-
Nick or Channel Chasing is
strictly prohibited.
-
Attempting to monitor or
tamper with another user’s
electronic communications,
or reading, copying,
changing or removing any
part of another user’s
nickserv/chanserv/memoserv/hostserv/botserv
account without the explicit
agreement of the owner.
-
You may not load to, or
control virus/Trojan
infected or otherwise
compromised IRC clients from,
the KoolIRC Network.
-
Adding, removing or
modifying identifying
network header information
in an effort to deceive or
mislead is prohibited.
Attempting to impersonate
any person by using forged
headers or other identifying
information is prohibited.
The use of anonymous
remailers or nicknames does
not constitute impersonation.

Harassment of an admin/ircop
to try and incite abuse
will not be tolerated. This will
result in 1 week gline or
more. Gline for this will
be issued by someone
other than the oper being

harassed
to curb “power abuse” complaints.

Not using any program
script/command, or sending
messages of any kind,
designed to interfere with
or to disable, a user's
terminal session, via any
means, locally or via the
Internet.

Harvesting, the collection
of email addresses, credit
card information, or other
personal information for
fraudulent use or sale is
prohibited.
-
Anyone Seen Promoting
another Network Will Be
Removed From the Server.

Network Administration Are
Not Liable For Any Violation
Of These Rules.
III. Available Services
Services are provided as a
convenience to users on the
network. The network is not
responsible for anything that
may occur due to services
downtime, outage, or loss of
data. Services are provided to
without charge and thus come
with no warranties, expressed or
implied.
a. Nickname Registration
1. Account names are registered on a first-come, first-serve basis.
2. If a user is using your nickname when you connect, you may recover your nickname by using
/NickServ RECOVER [nickname] [password].
3. Mass-registration of nicknames is expressly forbidden and abusers will get their nicks deleted.
Mass registering means registering multiple nicknames.
b. Channel Registration
1. Any user can register a channel on our network.
You must have a registered nick to register a channel.
2. Channels are governed by their respective owners. KoolIRC Administration will not be
involved in private channel disputes unless deemed appropriate by CSOP or Services Admins.

5. Abuse of ChanServ will result in network bans no shorter than 3 day. Continued Abuse will
be followed by a permanent network ban.
c. HostServ
Hostserv allows you to use a different Vhost of your choosing while identified and on this network.
Abuse of HostServ, including use of a host to impersonate someone you are not, or to attempt to
entice or otherwise harass users will result in you no longer being allowed to use this service, or access
to Services being denied to you.
d. Other Services
There are other services available to users on the network that are not specifically outlined in this
section. Abuse of any network service will result in denial of access to services, or to the network,
at the networks discretion.
IV. Security
You are responsible for any
misuse of your account, even if
the inappropriate activity was
committed by a friend, family
member, guest or employee.
Therefore, you must take steps
to ensure that others do not
gain unauthorized access to your
account. In addition, you may
not use your account to breach
security of another account or
attempt to gain unauthorized
access to another network or
server.

Your password
provides access to your account.
It is your responsibility to
keep your password secure.

Sharing your
password and account access with
unauthorized users is prohibited.
You should take care to prevent
others from using your account
since you will be held
responsible for such use.

Attempting to
obtain another user's account
password is strictly prohibited,
and may result in termination of
service.
·
You must adopt
adequate security measures to
prevent or minimize unauthorized
use of your account.
·
You may not
attempt to circumvent user
authentication or security of
any host, network or account.
This includes, but is not
limited to, accessing data not
intended for you, logging into
or making use of a server or
account you are not expressly
authorized to access, or probing
the security of other networks.
Use or distribution of tools
designed for compromising
security is prohibited. Examples
of these tools include, but are
not limited to, password
guessing programs, cracking
tools or network probing tools.

You may not
attempt to interfere with
service to any user, host or
network ("denial of service
attacks"). This includes, but is
not limited to; "flooding" of
networks, deliberate attempts to
overload a service, and attempts
to "crash" a host.

Users who violate
systems or network security may
incur criminal or civil
liability. KoolIRC
Administration will cooperate
fully with investigations of
violations of systems or network
security at other sites,
including cooperating with law
enforcement authorities in the
investigation of suspected
criminal violations.
V. Disclaimers
·
By connecting to
any KoolIRC Network, you
agree not to bring any legal
action against the server
administrators, IRC operators,
or any user representing the
KoolIRC Network.

KoolIRC
Staff members reserve the right
to interpret this “Acceptable
Use Policy” in the event there
is any judgment calls to be made
pertaining to a situation or
event which may not be spelled
out completely in this document.

We reserve the
right to deny access to this
Network without warning or
explanation.
VI. Limitation of Liability
In
no event shall KoolIRC
Network be Liable to any
party for any damages including
without limitation, any direct,
indirect, special, punitive,
incidental or consequential
damages(including, but not
limited to, damages for loss of
business profits, business
interruption, loss of programs
or information, loss of profits
and saving and the like), or any
other damages Arising – in any
way, shape or form – out of the
availability, use, reliance on,
inability to utilize or improper
use KoolIRC Services even if
KoolIRC Administration shall
have been advised of the
possibility of such damages, and
regardless of the form of
action, whether in contract,
tort, or otherwise because some
jurisdictions do not allow the
exclusion or limitation of
incidental or consequential
damages, the above exclusions of
incidental and consequential
damages may not apply to you.
VII. Proxy Checks
KoolIRC
performs checks for insecure
proxies, "Trojan horse" or
other harmful software on
your computer. These checks may appear in firewall logs as a
port scan. Use of KoolIRC
services indicates acceptance
of these checks. If you do
not want this test performed on your
system then you may disconnect.
If any such software is detected,
your computer may be blocked
from further use of KoolIRC
Services.
VIII. Consequences for Violation
If you violate any rule or
regulation stated in this
document or on the MOTD of any
KoolIRC server, you will be
subject to progressive
disciplinary action, including
but not limited to denial of
access to any KoolIRC server
or the entire network, or legal
action where applicable. Denial
of access to a particular
KoolIRC server can be made at
the server administrator's
discretion. Your Internet
provider may be denied access to
the server or network if you
successfully evade a ban.
KoolIRC Network is
under no circumstances to be
used for illegal activities.
Observed and verifiable
instances may be reported to the
appropriate authorities.
Although the KoolIRC
itself is an unmoderated forum,
the KoolIRC administration
will cooperate fully with any
officially recognized law
enforcement body to the best of
its capability when required to
do so by force of law.
IX. Appealing a Violation
If you are banned or denied
access to a KoolIRC server or
the entire network, you should
follow the procedure outlined
below. Please note, however,
that KoolIRC server
administrators are under no
obligation to take any further
action if you are denied access.

If you are K:lined (banned from a specific
server), contact the server
administration

(/ADMIN will display a contact e-mail
address) and request the
elimination of the ban,
explaining how future
incidents can be avoided.

If you are G:lined (banned from the entire
network for a particular
length of time), contact
abuse@koolirc.net and
request that the ban be
lifted, explaining how
future incidents
-
can be avoided.
KoolIRC Administration reserves the right to alter this AUP and any terms and conditions of service
at any time without prior notice.
